Article 1 — Purpose and scope
These general terms and conditions of sale and hire (the ‘Terms of Sale’) govern the hire of sound and DJ equipment and the associated services (delivery, set-up) offered by Sono Côte Basque (the ‘Lessor’) to any natural or legal person (the ‘Hirer’) via the website https://sonocotebasque.fr. Any booking implies unreserved acceptance of these Terms of Sale.
Article 2 — Identity of the Lessor
Sono Côte Basque — Sole trader (French auto-entreprise / micro-entreprise)
Registered office: 14 rue Jean Bart, 64200 Biarritz
SIRET: 810 517 508 00026
VAT not applicable, Article 293 B of the French General Tax Code

Article 3 — Booking
Bookings are made online or on the basis of a quote, for a fixed start date and end date. A quote sent by the Lessor may be accepted online via its link: the equipment is then held for 3 days pending the first payment provided for in the quote; failing this, the booking is cancelled at no cost and the equipment released. Every hire has a minimum duration of 3 hours. Bookings must be made at least 48 hours before the start of the hire; within this period, the Hirer is invited to contact the Lessor directly, who remains free to accept or decline the request. The booking is only firm after the first scheduled payment (Article 5), or, for payment in cash, after the file has been completed (contact details, acceptance of these terms, identity check if requested and registration of the guarantee card). Equipment is booked subject to availability.
Article 4 — Prices
Prices are given in euros, per day of hire. Any 24-hour period that has begun is due in full (a hire of more than 24 hours is charged as 2 days, etc.). Any delivery charges are added to the hire price and are calculated by distance (Article 7). ‘Long hire’ discounts apply automatically to the equipment according to the length of hire (15% from 24h, 20% from 48h, 25% beyond 72h); they do not apply to delivery charges. The Lessor reserves the right to change its prices at any time; the applicable price is the one in force at the time of booking.
Article 5 — Payment (deposit and balance)
The method of payment (bank card, bank transfer or cash) and the payment schedule are stated on the quote or during online booking. Unless otherwise stated, the Hirer pays, on booking, a deposit of 20% of the total amount, which confirms the booking; the quote may provide for a different deposit rate or for payment of the full amount in a single instalment. The deposit is non-refundable (Article 12). The balance (80% unless another rate applies) is due no later than 24 hours before the start of the hire. For a hire starting less than 48 hours after acceptance of the quote, the full amount is paid on acceptance (by card, or by instant bank transfer). A receipt is sent to the Hirer for each payment.
Bank card. Payment is made online via our secure payment provider Stripe. The card used is saved by Stripe and the Hirer authorises the Lessor to automatically charge the balance to this card 24 hours before the start of the hire. If no card is saved or if the charge fails, a payment link is sent to the Hirer, who must pay the balance before the start of the hire.
Bank transfer. The deposit (or the full amount) is transferred with the reference given in the file; the booking is confirmed on receipt. The balance is transferred no later than 24 hours before the start of the hire.
Cash. The amount due is paid no later than when the equipment is handed over (pickup or delivery).
If the balance is not paid within the time limits, the booking may be cancelled automatically and the equipment made available for hire again, with the deposit retained by the Lessor (Article 12); in any event, the Lessor may refuse to hand over the equipment until the balance has been paid.
Article 6 — Guarantee (registered card)
For every hire, whatever the method of payment, the Hirer registers a guarantee bank card via Stripe before the start of the hire (for payment by card, this is the card used for the deposit). No amount is held or charged on this basis if the equipment is returned complete, in good condition and on time. In the event of damage, loss, theft or incomplete or late return, the Hirer authorises the Lessor, after informing the Hirer, to charge this card the corresponding amount (repair, replacement at replacement value, late fees), on presentation of supporting documents, without prejudice to any other action if the loss exceeds this amount. If the card has not been registered before the start of the hire, the Lessor reserves the right to refuse to hand over the equipment.
Article 7 — Pickup and delivery
The equipment may be picked up by the Hirer from our pickup point in Anglet (exact address provided on confirmation of the hire), or delivered and set up by the Lessor. Delivery is offered within a radius of 150 km; up to 20 km a flat fee applies, beyond that a surcharge is calculated according to road distance. Beyond 150 km, the Hirer is invited to contact us. Collection and return times are agreed between the parties.
Article 8 — Hire period
The hire starts and ends on the agreed dates and times. A buffer period is kept between two hires for transporting and checking the equipment. The equipment must be returned in the condition in which it was handed over, on the scheduled date and time.
Article 9 — Use of the equipment — obligations of the Hirer
The Hirer undertakes to use the equipment with the care of a reasonable and prudent person, in accordance with its intended purpose and the instructions provided, to protect it from bad weather and from any dangerous handling, not to sub-let or lend it, and not to move it from the agreed location without the Lessor's consent. The Hirer is responsible for the equipment for the entire duration of the hire, from the moment it is made available until its return.
Article 10 — Return
The equipment is returned complete, clean and in good working order. Any late return may be charged at the daily rate in force. Any missing or damaged item will be charged to the Hirer on the basis of its replacement or repair value.
Article 11 — Liability, loss, theft and damage
The Hirer has custody of and responsibility for the equipment for the duration of the hire and is liable for any loss, theft or damage, whatever the cause. It is the Hirer's responsibility to take out insurance accordingly. The Lessor cannot be held liable for indirect damage, or for any loss resulting from misuse of the equipment by the Hirer. In any event, the Lessor's liability is limited to the amount of the hire concerned.
Article 12 — Cancellation
If the Hirer cancels, the deposit paid is retained by the Lessor; any refund of sums paid in excess of the deposit is considered on a case-by-case basis. If the balance is not paid within the time limit set out in Article 5, the booking may be cancelled and the equipment released, with the deposit retained. An accepted quote for which the first payment is not received within 3 days is cancelled at no cost (Article 3). If the Lessor cancels (in particular due to unavailability or force majeure), the sums paid are refunded in full, to the exclusion of any other compensation.
Article 13 — Force majeure
The Lessor cannot be held liable for non-performance due to an event of force majeure within the meaning of Article 1218 of the French Civil Code and applicable case law.
Article 14 — Personal data
The Lessor, as data controller, collects the personal data of the Hirer (identity, contact details, delivery address) for the purposes of managing bookings, payments, invoicing and customer relations. The legal basis is the performance of the contract and, where applicable, compliance with legal obligations. The data is not transferred to third parties for commercial purposes; it is disclosed to the payment provider Stripe (which alone processes bank card data) and to the technical service providers strictly necessary for the service. It is kept for the duration of the business relationship, then archived in accordance with legal obligations (in particular 10 years for accounting records). In accordance with the GDPR and the French Data Protection Act (loi Informatique et Libertés), the Hirer has the right of access, rectification, erasure, restriction, objection and portability, which the Hirer may exercise at contact@sonocotebasque.fr. The Hirer may also lodge a complaint with the CNIL (www.cnil.fr).
Article 15 — Complaints, mediation and disputes
Any complaint may be sent to contact@sonocotebasque.fr. In accordance with Articles L611-1 et seq. of the French Consumer Code, a Hirer who is a consumer may, in the event of an unresolved dispute, refer the matter free of charge to the consumer mediator NotreAccord: mediation-consommation.notreaccord.com. Failing an amicable resolution, these Terms of Sale are governed by French law and any dispute falls within the jurisdiction of the French courts.
